Protecting the Rights of Consumers For Over 25 Years

Q. I’m being sued by credit card company for fraudulent charges made by someone else. The charges were made in California. I can prove that I was in Chicago Illinois working at the time. I have a police report and pay stubs to prove it. The credit card company wants me to pay for the charges I did not make anyway. I couldn't take the day off from work for my court date.

A. It is unclear from your question whether a judgment was entered, but even if it was, it is relatively easy to have a judgment vacated on motion filed within 30 calendar days (not 31) of the judgment. Please contact us immediately.

Furthermore, if a claim of fraud is wrongfully denied, the party suing you or its attorneys may be violating the Fair Debt Collection Practices Act, Truth in Lending Act (Fair Credit Billing provisions), and/or the Fair Credit Reporting Act.

We regularly defend credit card cases for a modest fee. We do not charge anything for consulting us about such cases. We also represent on a contingent basis consumers injured by violations of the FDCPA, TILA, and FCRA.
